Fair Tenant Screening Act recommends that landlords establish and consistently follow formal rental criteria when evaluating prospective residents. Doing so helps ensure fairness and avoid fair housing claims. See RCW 59.18.257 for exact language.

What This Means to You:

Rental Criteria:
Every landlord must provide Rental Criteria to prospective tenants at the time the prospective tenant receives a Rental Application. If you have a website, you can have your criteria posted on your website. If you don’t have a website, you must email or supply hard copy of your criteria.

If you have not developed a Rental Criteria for your tenants, you can review the Rental Criteria Sample forms (Form 13 and 13A) on the website:

The RAWV strongly recommends that you have the prospective tenant(s) sign your Criteria Form and return it along with the completed application.

Adverse Action:
If an applicant does not meet your criteria and you do not to rent to them, you MUST provide a written notice explaining the reasons. You can use RAWV Form #12 “Denial of Application /Adverse Action."

If you prefer to email the application document to your prospective tenant, along with your criteria, please download this application by saving it to your computer, then attach it in an email with your criteria.
